Leverkusen, Germany, Oct 18, 2007 - (Hugin via Asia Business News) - Leverkusen, 18 October 2007 - Biofrontera AG announces that its subsidiary for marketing and sales, Biofrontera Pharma GmbH, was forbidden, through a preliminary injunction of the higher regional court of Hamburg, to publicly use particular advertising material for BF-200 ALA-Rezeptur, a pharmaceutical gel compounded by pharmacies.

The appeal of Galderma Laboratories GmbH was first rejected by the regional court of Hamburg. This appeal has now partly been granted by the higher regional court. According to the preliminary injunction, Biofrontera is not allowed to advertise for the mail order trading of BF-200 ALA-Rezeptur, a pharmacy compounding product combining ALA with a nanoemulsion. In contradiction to the regional court, other German courts and general praxis in pharmacies, the court granted the injunction partly with the argument that pharmacy permits for mail ordering are not applicable to pharmacy compounding products. For other parts of the appeal the rejection of the regional court was confirmed.
