Stuttgart, Dec 17, 2008 AEST (ABN Newswire) - Celesio AG (FRA:CLS)(PINK:CAKFY) Three months after the oral hearings were held at the European Court of Justice (ECJ), the Advocate General Yves Bot today published his opinion on the issue of third-party ownership in the case of the German branch of the Celesio subsidiary DocMorris (AZ C-171-07).
"Issuance of the final opinion brings us a step closer to a decision by the ECJ," said Fritz Oesterle, Chairman of the Management Board of Celesio AG. "The decision of the ECJ will finally give us clarity about the future development of pharmaceutical markets in Germany." Celesio needs this certainty to be able to plan for the future growth of the Company.
Celesio, one of Europe's leading trading and services companies for pharmaceuticals, bought Apotheke DocMorris in April 2007 in order to utilise the developing opportunities in pharmaceutical markets in Germany. DocMorris is Germany's best known pharmacy brand and Europe's largest mail-order pharmacy. The Company, which has its headquarters in the Netherlands, has been operating its own pharmacy in Saarbrucken since July 2006. Licensing of the pharmacy in Saarbrucken by the Department of Health in the Saarland was the starting point of the ECJ case for which the Advocate General today issued an Opinion.
For the past two years, Apotheke DocMorris has also offered brand cooperation to independent pharmacies across Germany. This cooperation means that Apotheke DocMorris has a presence in all Federal States in Germany.
